Terms
Last updated October 27, 2026.
These terms are a contract between you and Dava Labs LLC, a New York limited liability company doing business as Artmoe (“Artmoe”, “we”, “us”). They apply when you use artmoe.com, upload a photo, ask for a preview or buy from us. You accept them when you tick the box or press the button that says you agree, and again each time you place an order. If you do not agree, please do not use the site.
Please read section 15, “If we disagree”. It says that most disputes between us are decided by a neutral arbitrator, one person at a time, and not in court, not by a jury and not as a class action. You can opt out within 30 days of first accepting these terms.
1. Who can use the site
You must be at least 18 years old and live in the United States, and you must be buying for yourself or as a gift, not for resale. The site is not meant for children, and we do not knowingly collect information from anyone under 13.
2. What we make, and your approval
Each portrait is made by computer software, including artificial-intelligence image models, from the photos you send us. No person paints it. Because those models decide many details themselves, every result is different, and a portrait may change, leave out or add details, including markings, colors and features of your pet. We do not promise that a portrait is an exact likeness.
If you saw a free, watermarked preview before you paid, what you bought is the image shown in it, at full resolution and without the watermark. Before you buy after a preview, look at it carefully and make sure you are happy that it looks like your pet. By buying after a preview, you confirm that you have done so and that you approve the portrait as shown. We do not repaint or refund a portrait you saw in a preview because of how it looks.
When you order before your portrait is made, it is digitally painted from your photo after you pay. You approve it before it is printed only if you add the artwork proof. For such an order, our Returns page says when we make your portrait again, or refund you, if it does not look like your pet.
Colors on a screen differ from colors on paper, and screens differ from one another, so a print can look a little lighter, darker or warmer than the preview. Small differences in color, cropping at the edges and paper texture are normal and are not defects.
We may decline to make or deliver any image, for example if a photo breaks these terms or the image models’ safety filters stop it. If we decline after you have paid, we refund you in full.
3. Your photos
For now we paint pets only. Please upload photos in which no person can be recognized. We may reject or crop a photo that shows a person.
When you upload a photo, you promise that:
- you took the photo, or you have the right to use it for this;
- it does not break any law or anyone else’s rights, including copyright and privacy rights;
- it shows nothing sexual, hateful, violent or cruel to animals.
You keep every right you have in your photos. You give us, and the companies that help us (listed on our Privacy page), permission to copy, store and change them only to make, show and deliver your previews and portraits, to keep the site safe, and to follow the law. This permission ends when we delete the photos on the schedule in our Privacy page.
4. Photos of people
This section applies only once we offer portraits of people, and only to photos in which a person can be recognized. When it applies, you also promise that:
- every adult who can be recognized has agreed to the photo being used to make a portrait;
- for anyone under 18, you are that child’s parent or legal guardian and you agree on the child’s behalf;
- the photo does not show a celebrity, a public figure or anyone else who has not agreed, and you will not use the portrait to mislead anyone about who a person is or what a person did.
We treat your photo as a picture to paint from. We do not use it to identify anyone, and we do not create or keep face templates or other biometric identifiers. Our Privacy page says more.
5. Your portrait and our ads
We do not use your photos or your portrait in our ads, on our site or on our social pages. If we ever want to, we will ask you first, separately, and only use it if you say yes. Saying no will never affect your order.
6. What you may do with your portrait
Once you have paid, you may keep, print, frame, give away and share your portrait, including on social media, for personal, non-commercial use, for as long as you like. You may not sell it, put it on products for sale or register it as a trademark without our written permission.
The paintings we start from are in the public domain in the United States. Images made mostly by software may not be protected by copyright, and the same software can make similar images for other people, so we do not promise that your portrait is unique or exclusive to you. We keep the right to make portraits in the same styles for others.
7. Our site
The site, our name, logo, wording, design and code belong to us. You agree not to:
- copy the site or use automated tools to collect from it;
- get around its limits, watermarks or safety filters;
- upload anything harmful to the site or to other people;
- use the site for anything unlawful.
We may limit or end anyone’s use of the site if they break these terms.
Our site uses a cookie and a measurement tool from Meta (Facebook and Instagram), where we run our ads. It records your visit and the steps you take on the site, such as asking for a preview, adding your photo to an order or buying, so we can tell which ads work and show them to people likely to be interested. It never receives your photos or portraits. Our Privacy page explains what it collects and how to turn it off.
8. Prices and payment
Prices are in US dollars and include US shipping. Sales tax is added at checkout where the law requires it. Payment is handled by Stripe; we never see or store your full card number.
Your order is accepted when we send the order confirmation email. If a price or description on the site was clearly wrong because of a mistake, we may cancel the order and refund you in full, even after you have paid.
Promotion codes and offers cannot be combined, and none applies to an order already placed.
9. Delivery
A digital portrait is delivered when we email you the download link. Please download it and keep your own copy; we keep it available as long as we reasonably can, but we do not promise to store it forever.
Prints are covered by our Shipping page. Ownership of a print, and the risk of its loss, pass to you when we hand it to the carrier. A print that the carrier’s tracking shows as delivered to the address you gave us has been delivered. Our Returns page still protects you if a print arrives damaged or is never delivered.
10. Reprints and refunds
Every portrait is made to order, so all sales are final: except as our Returns page says, we do not accept returns or give refunds for a change of mind. We do not remake or refund a portrait you approved in a free preview because of how it looks. Our Returns page is our limited warranty. It explains the cases in which we remake, resend, reprint or refund. Those are your only remedies for a portrait or print that is not right, except for rights the law gives you that cannot be waived.
11. What we do not promise
APART FROM THE LIMITED WARRANTY ON OUR RETURNS PAGE, THE SITE, THE PREVIEWS AND THE DIGITAL PORTRAITS ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
FOR THE SITE, THE PREVIEWS AND THE DIGITAL PORTRAITS, AS FAR AS THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT A PORTRAIT IS AN ACCURATE LIKENESS.
FOR PRINTS, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, LASTS ONLY 30 DAYS FROM DELIVERY OR, WHERE OUR RETURNS PAGE OFFERS TO MAKE YOUR PORTRAIT AGAIN, UNTIL YOUR TIME TO ASK FOR THAT ENDS, IF LATER.
Some states do not allow limits on how long an implied warranty lasts, so the limit above may not apply to you.
We do not promise that the site will always work, be secure or be free of errors.
12. Limits on our responsibility
AS FAR AS THE LAW ALLOWS, WE ARE NOT RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE LOSS, OR FOR LOST PROFITS, LOST DATA OR EMOTIONAL DISTRESS, ARISING FROM THE SITE OR FROM ANYTHING WE MAKE, EVEN IF WE WERE TOLD IT MIGHT HAPPEN.
AS FAR AS THE LAW ALLOWS, EVERYTHING WE COULD OWE YOU, FOR ANY REASON AND UNDER ANY LEGAL THEORY, IS LIMITED TO THE AMOUNT YOU PAID US FOR THE ORDER THE CLAIM IS ABOUT OR, IF THERE IS NO ORDER, 50 US DOLLARS.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the limits above may not apply to you.
These limits do not apply to our gross negligence, to harm we cause on purpose, to fraud, to personal injury caused by our negligence, or to anything else the law does not allow us to limit. They apply to us and also protect our owners, staff and the companies that help us.
13. If someone else makes a claim
If someone makes a claim against us because a photo you uploaded broke a promise in section 3 or 4, or because you misused the site or a portrait, you agree to cover our reasonable losses and costs from that claim, including reasonable lawyers’ fees, as far as the law allows. We will tell you promptly about any such claim.
14. If you think something infringes your rights
If you believe a photo or portrait on our site infringes your copyright or uses your image without permission, write to hello@artmoe.com or to the address in section 17. Tell us who you are, what the work or image is, where you saw it and how to reach you. We will look into it promptly and remove what should not be there.
15. If we disagree
Talk to us first. Most problems are solved by an email to hello@artmoe.com. Before starting any claim, you must write to us with your name, your order reference, what happened and what you want. If we have a claim against you, we must write to you at your email address in the same way. You and we will then try in good faith to settle it for 60 days. Any time limit for bringing the claim is paused during those 60 days.
Arbitration. If we cannot settle it, you and we agree that any dispute about the site, our products, our marketing or these terms, including disputes that arose before you accepted them, will be decided by binding arbitration run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court. The rules are at adr.org. The Federal Arbitration Act governs this section. The arbitrator, and not a court, decides whether a dispute must be arbitrated and whether this section is valid, except that a court decides whether the “One at a time” paragraph can be enforced.
How it works. The arbitration can take place by video, by phone, on written papers alone, or in person in the county where you live. We pay the filing, administration and arbitrator fees that the AAA rules assign to the business, and we will not ask you to pay our lawyers’ fees unless the arbitrator finds your claim was frivolous. The arbitrator can award you, individually, anything a court could.
What stays out of arbitration. Either of us may take a claim to small claims court if it qualifies there. Either of us may go to court to stop misuse of intellectual property or abuse of the site.
One at a time. YOU AND WE EACH GIVE UP THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR JOIN A CLASS ACTION, A CLASS ARBITRATION OR ANY CLAIM ON BEHALF OF OTHERS. The arbitrator may award relief only to you and only as needed to resolve your own claim. If this paragraph cannot be enforced for a particular claim or request for relief, including a request for a public injunction, that claim or request goes to court after the arbitration of everything else is finished, and the rest of this section still applies.
Many claims at once. If 25 or more similar claims are filed by or with the help of the same lawyers or organization, the AAA’s Mass Arbitration Supplementary Rules apply. Time limits are paused for each claim from the day it is filed until it is decided.
Opting out. You may opt out of arbitration within 30 days of first accepting these terms, by emailing hello@artmoe.com or by writing to the address in section 17, giving your name and email address and saying that you opt out. Opting out changes nothing else in these terms, and we will not treat you differently for it.
Time limit. As far as the law allows, any claim must be started within one year of when it arose, or it is given up.
Which law and which courts. New York law governs these terms, without its rules on choosing another state’s law. Any matter that goes to court (other than small claims) will be heard only in the state or federal courts in New York County, New York, and you and we agree to those courts and give up the right to a jury there.
Changes to this section. If we change this section, the change does not apply to a dispute we already knew about, and you may reject the change within 30 days by writing to us, in which case the earlier version applies to you.
16. Everything else
- We may change these terms. Changes apply to orders placed after we post them, and the date at the top will change. The terms you accepted when you ordered apply to that order.
- We are not responsible for delays or failures caused by things outside our reasonable control, such as carrier or supplier problems, outages, storms or strikes.
- If any part of these terms cannot be enforced, that part is limited as little as necessary and the rest still applies.
- If we do not enforce a part of these terms at once, we may still enforce it later.
- These terms, with our Privacy, Returns and Shipping pages, are the whole agreement between us. We may pass them on to a company that takes over the business; you may not pass them on.
- Sections 3 to 6 and 10 to 16 continue to apply after you stop using the site.
- You agree that we may send notices and receipts to you by email, and that an electronic acceptance counts as your signature.
